1. About these terms

These Terms of Service apply when you visit shopmapleandmoss.com or purchase goods, digital content or other products from Maple & Moss.

In these terms, “Maple & Moss”, “we”, “us” and “our” refer to the operator of the Maple & Moss online store. “You” and “your” refer to the customer or website visitor.

By placing an order, you agree to these terms. Please read them before purchasing. Nothing in these terms limits your mandatory rights under consumer law.

3. Using our website

You may use our website only for lawful purposes.

You must not:

  • Use the website fraudulently or unlawfully

  • Introduce viruses, malicious code or other harmful material

  • Attempt to gain unauthorised access to the website, another customer’s account or connected systems

  • Scrape, copy or exploit the website or its content for commercial purposes without permission

  • Interfere with the website’s security, operation or availability

  • Use our products or content in a way that infringes another person’s rights

We may restrict access where reasonably necessary to protect customers, the business or the website.

4. Product information

We take reasonable care to describe and display products accurately. Colours and appearance may vary slightly because of lighting, photography, screens, natural materials or manufacturing differences.

Product measurements and other details are approximate unless stated otherwise.

Some physical products are supplied or dispatched by carefully selected third-party fulfilment partners. Items in the same order may arrive separately and in different packaging. This does not affect your contract with Maple & Moss or your consumer rights against us.

5. Orders and acceptance

Placing an order is an offer to purchase the selected products.

After ordering, you should receive an acknowledgement email. This confirms that we received the order but does not necessarily mean it has been accepted.

A contract for physical goods is formed when we confirm dispatch, unless we expressly state otherwise. A contract for digital content is formed when we accept payment and make the content available.

We may decline or cancel an order for a legitimate reason, including:

  • A product being unavailable

  • An obvious pricing or description error

  • Payment not being authorised

  • Suspected fraud or misuse

  • Delivery not being available to the supplied address

  • A legal or regulatory requirement

If we cancel an order after payment, we will refund the amount paid for the cancelled item.

6. Prices and payment

Prices are shown in pounds sterling unless another currency is displayed at checkout.

The total price, applicable taxes and delivery charges will be shown before you place the order.

Payment must be authorised using one of the payment methods offered at checkout. We do not receive your complete card details; payments are processed by Shopify and the applicable payment provider.

If a price is clearly incorrect, we may contact you before accepting the order to offer the correct price or cancel the affected item and issue a refund.

7. Physical-product delivery

Available delivery options, charges and estimated times are displayed at checkout or in our Shipping Policy.

Delivery dates are estimates unless we expressly agree to a guaranteed date. Different items may be sent separately by different fulfilment partners.

We are responsible for the goods until they are delivered to you or a person you nominate. You are responsible for providing a complete and accurate delivery address and for notifying us promptly of any error.

8. Digital products and immediate supply

Digital products may include journals, printables, ebooks, artwork, templates, sticker files or similar downloadable content.

Before immediate digital supply begins, you may be asked to expressly consent to receiving the content during the 14-day cancellation period and to acknowledge that your cancellation right will be lost once supply begins.

Digital products are supplied to the email address or customer account associated with the order. You are responsible for entering a valid email address and checking compatibility requirements shown in the product description.

Unless a product listing expressly grants broader rights, digital products are licensed to you for personal, non-commercial use only. You must not:

  • Resell, redistribute, share or sublicense the files

  • Upload them to file-sharing services

  • Claim the content as your own

  • Use the content to produce items for commercial sale

  • Remove copyright or ownership notices

Your statutory rights in faulty digital content remain unaffected.

9. Intellectual property

The website and its original content—including branding, illustrations, designs, graphics, text, digital products and downloadable files—are owned by or licensed to Maple & Moss or the relevant creator.

Buying a product does not transfer intellectual-property ownership to you.

Third-party brand names and product materials remain the property of their respective owners.

10. Cancellations, returns and refunds

Your cancellation, return and refund rights are explained in our Return and Refund Policy, which forms part of these terms.

Nothing in that policy or these terms limits rights provided by the Consumer Rights Act 2015, Consumer Contracts Regulations 2013 or other applicable consumer law.

11. Product safety and appropriate use

Please read and follow all labels, instructions, warnings and care information supplied with a product.

Candles, wax products, diffusers, oils, cosmetics and similar products must be used only as directed and kept away from children and pets where indicated. Never leave a burning candle unattended.

Self-care and lifestyle products are not medical products and are not intended to diagnose, treat, cure or prevent illness unless expressly stated and legally authorised.

If you have allergies, sensitivities, a medical condition or concerns about ingredients, review the product information and seek appropriate professional advice before use.

12. Discount codes and promotions

Discounts and promotions are subject to the conditions stated with the offer.

Unless stated otherwise:

  • Codes cannot be exchanged for cash

  • Only one code may be used per order

  • Codes must be entered before checkout is completed

  • Offers may be limited by product, customer, territory or expiry date

We will not withdraw a promotion from an order after it has been validly accepted, except where required to correct fraud or a genuine error.

13. Reviews and submitted content

If you submit a review, photograph or other content, it must be honest, lawful and based on your genuine experience.

You must not submit material that infringes another person’s rights, contains unlawful content or includes another person’s private information without permission.

You retain ownership of your content but grant us a non-exclusive permission to display and use it in connection with the store and our marketing. We will moderate content fairly and in accordance with applicable law.

14. Website availability and external services

We try to keep the website available and accurate but cannot guarantee uninterrupted access.

Shopify, payment providers, delivery companies, fulfilment partners and other services may operate parts of the shopping and delivery process. Their service interruptions may affect the website or an order.

Links to third-party websites are provided for convenience. We are not responsible for their independent content, privacy practices or services.

15. Our responsibility to you

We are responsible for losses that are a foreseeable result of our breach of these terms or failure to use reasonable care and skill.

We do not exclude or limit liability where doing so would be unlawful, including liability for:

  • Death or personal injury caused by negligence

  • Fraud or fraudulent misrepresentation

  • Breach of your mandatory consumer rights

  • Defective products where liability cannot lawfully be excluded

We are not responsible for losses caused by events outside our reasonable control, provided we take reasonable steps to reduce the effect of the event.

Products are intended for personal consumer use. We are not responsible for business losses, loss of profit or loss of business opportunity arising from consumer purchases.

16. Privacy

We process personal information in accordance with our Privacy Policy.

Shopify and other service providers may process information to operate the store, take payment, prevent fraud and fulfil orders.

17. Changes to these terms

We may update these terms to reflect changes to the store, our products or the law.

The terms that apply to an order are those made available when the order is placed. Later changes will not retrospectively alter an existing order unless required by law or agreed with you.

18. Severability and waiver

If any part of these terms is found to be unlawful or unenforceable, the remaining terms will continue to apply.

If we do not enforce a term immediately, that does not prevent us from enforcing it later.

19. Governing law and disputes

These terms are governed by the laws of England and Wales.

If you live in Scotland or Northern Ireland, you retain the protection of the mandatory consumer laws that apply where you live and may bring proceedings in your local courts where the law permits.
